Armed reprisals are the limited use of military force in response to unlawful actions perpetrated against states. Historically, reprisals provided a military remedy for states that had been wronged by another state without having to resort to all-out war in order to counter or deter such wrongful actions. While reprisals are broadly believed to have been outlawed by the UN Charter, states continue to routinely undertake such self-help measures. As part of the roundtable, “The Ethics of Limited Strikes,” this essay (...) examines the doctrine of armed reprisals in light of recent instances of states using force “short of war” in this manner. We argue that the ban on reprisals has been largely ignored by states, and that recent attempts to apply the laws of armed conflict to the cyber domain are further weakening this prohibition. We conclude that this is a potentially dangerous development that lowers the bar for resorting to military force, risking escalation and thereby further destabilizing the international system. Despite the positive effects of including patients’ preferences into therapy on psychotherapy outcomes, there are still few thoroughly validated assessment tools at hand. We translated the 18-item Cooper-Norcross Inventory of Preferences into German and aimed at replicating its factor structure. Further, we investigated the reliability of the questionnaire and its convergence with trait measures. A heterogeneous sample of N = 969 participants took part in our online survey. Performing ESEM models, we found acceptable model fit for a four-factor structure similar (...) to the original factor structure. Furthermore, we propose an alternative model following the adjustment of single items. The German C-NIP showed acceptable to good reliability, as well as small correlations with Big-Five personality traits, trait and attachment anxiety, locus of control, and temporal focus. However, we recommend further replication of the factor structure and further validation of the C-NIP. (shrink)

The Logic of Liberal Rights uses basic logic to develop a model of argument presupposed in all disputes about civil rights and liberties. No prior training in logic is required, as each step is explained. This analysis does not merely apply general logic to legal arguments but is also specifically tailored to the issues of civil rights and liberties. It shows that all arguments about civil rights and liberties presuppose one fixed structure and that there can be no original argument (...) in rights disputes, except within the confines of that structure. Concepts arising in disputes about rights, like 'liberal' or 'democratic', are not mere abstractions but have a fixed and precise character. This book integrates themes in legal theory, political science and moral philosophy, as well as the philosophy of logic and language. For the advanced scholar, the book provides a model presupposed by leading theoretical schools . For the student it provides a systematic theory of civil rights and liberties. Examples are drawn from the European Convention in Human Rights but no special knowledge of the Convention is assumed, as the issues analysed arise throughout the world. Abstract Finding a moral justification for humanitarian intervention has been the objective of a great deal of academic inquiry in recent years. Most of these treatments, however, make certain arguments or assumptions about the morality of humanitarian intervention without fully exploring their precise philosophical underpinnings, which has led to an increasingly disjointed body of literature. The purpose of this essay, therefore, is to suggest that the conventional arguments and assumptions made about the morality of humanitarian intervention can be encompassed in (...) what is essentially a consequentialist framework. After a brief examination of consequentialist ethics, this essay reveals a number of morally relevant factors concerning humanitarian intervention, wherein I suggest that the general consensus in the literature on these factors constitutes ?commonsense morality?. In doing so, I argue that consequentialism as a theory of the right provides the best fit with commonsense morality on humanitarian intervention. This is important not only to reveal the precise philosophical underpinnings of the debate, but also to bring ethical, prudential and political considerations together in a coherent ethical discourse. Legal scholars’ interest in Shakespeare has often focused on conventional legal rules and procedures, such as those of The Merchant of Venice or Measure for Measure. Those plays certainly reveal systemic injustice, but within stable, prosperous societies, which enjoy a generally well-functioning legal order. In contrast, Shakespeare's first historical tetralogy explores the conditions for the very possibility of a legal system, in terms not unlike those described by Hobbes a half-century later. The first tetralogy's deeply collapsed, quasi-anarchic society lacks any (...) functioning legal regime. Its power politics are not, as in many of Shakespeare's other plays, merely latent, lurking beneath the patina of an otherwise functioning legal order. They pervade all of society. Dissenting from a long critical tradition, this article suggests that the figure of Henry VI does not merely represent antiquated medievalism or inept rule. Through Henry's constant recourse to legal process, arbitration and anti-militarism, the first tetralogy goes beyond questions about how to establish a functioning legal order. This article explores the extent to which the decision to invade Iraq in 2003 coheres with the normative precepts of liberalism as an international political theory. Beginning with a Lockean liberal theory of the state, this article first examines the evolution of international liberalism in order to identify the fundamental normative postulates of liberal theory as it pertains to international relations, especially regarding the use of military force. The article then advances two interrelated arguments: First, that the underpinnings of the (...) decision to invade Iraq embodied in the Bush Doctrine draw heavily from the liberal tradition, though still depart from it in important ways. Second, that the Bush Doctrine as manifested in the Iraq war reflects in many ways the liberal thinking that prevailed during the interwar years and is therefore susceptible to a similar charge of ‘utopianism’ that was leveled against interwar liberalism by E. Anesthesiology training programs are tasked with equipping trainees with the skills to become medically and ethically competent in the practice of anesthesia and to be prepared to obtain board certification, yet there is currently no standardized ethics curriculum within anesthesia training programs in the United States. To bridge this gap, and to provide a validated ethics curriculum to meet the aforementioned needs, in July 2021, a survey was sent to anesthesia scholars in the field of biomedical ethics to identify key (...) areas that should be included in such an ethics curriculum. The responses were rated on a Likert scale and ranked. This paper identifies the top ten topics identified as high priority for inclusion in an anesthesiology training program and consequently deemed most relevant to meet the educational needs of graduates of an anesthesiology residency: (1) capacity to consent; (2) capacity to refuse elective versus lifesaving treatment; (3) application of surrogate decisionmaking; (4) approach to do not resuscitate (DNR) status in the operating room; (5) patient autonomy and advance directives; (6) navigating patient beliefs that may impair care; (7) “futility” in end-of-life care: when to withdraw life support; (8) disclosure of medical errors; (9) clinical criteria for “brain death” and consequences of this definition; and (10) the impaired anesthesiologist. Extensive research has demonstrated that rs1360780, a common single nucleotide polymorphism within the FKBP5 gene, interacts with early-life stress in predicting psychopathology. Previous results suggest that carriers of the TT genotype of rs1360780 who were exposed to child abuse show differences in structure and functional activation of emotion-processing brain areas belonging to the salience network. Extending these findings on intermediate phenotypes of psychopathology, we examined if the interaction between rs1360780 and child abuse predicts resting-state functional connectivity (rsFC) between the amygdala (...) and other areas of the salience network. We analyzed data of young European adults from the general population (N = 774; mean age = 18.76 years) who took part in the IMAGEN study. In the absence of main effects of genotype and abuse, a significant interaction effect was observed for rsFC between the right centromedial amygdala and right posterior insula (p <.025, FWE-corrected), which was driven by stronger rsFC in TT allele carriers with a history of abuse. Our results suggest that the TT genotype of rs1360780 may render individuals with a history of abuse more vulnerable to functional changes in communication between brain areas processing emotions and bodily sensations, which could underlie or increase the risk for psychopathology. Bullying often results in negative coping in victims, including an increased consumption of alcohol. Recently, however, an increase in alcohol use has also been reported among perpetrators of bullying. The factors triggering this pattern are still unclear. We investigated the role of empathy in the interaction between bullying and alcohol use in an adolescent sample (IMAGEN) at age 13.97 (±0.53) years (baseline (BL), N = 2165, 50.9% female) and age 16.51 (±0.61) years (follow-up 1 (FU1), N = 1185, 54.9% female). (...) General empathic distress served as a significant moderator of alcohol use in perpetrators (F9, 493 = 17.978, p < 0.01), which was specific for males and FU1. Male perpetrators, who are generally less sensitive to distress, might thus be more vulnerable to alcohol abuse. (shrink)

Especially where a patient's ability to communicate is limited, the receptive use of art visually offers an entry point into contemplation and insight. Here, receptive work with visual art can help to dissolve limitations in verbal communication. In receptive art therapy, an independent therapeutic resource is attributed to the artistic work and its symbolic pictorial content, which can initiate a healing process. A form of indirect communication is stimulated, in which not only a change on the symbolic but also on (...) the emotional level takes place through the emotionally highly charged pictorial-symbolic expression in the confrontation. Most Western democracies and international institutions have currently adopted a range of policies aimed at regulating hate speech. However, the kinds of target groups that hate speech regulations seek to protect have not been clearly defined yet. In a series of publications, Eric Heinze has challenged the coherence of such regulations. His core thesis is that hate speech laws have simply no place in longstanding, stable, and prosperous democracies. An old book by children’s author Dr. Seuss can be an inspiration to examine the ethical and ontological meaning of geoengineering. My argument is based on my critique of the process of ecological restoration as the creation of an artifactual reality. When humanity intentionally interferes with the processes and entities of nature, we change the ontological reality of the natural world. The world becomes a garden, or a zoo, an environment that must be continually managed to meet the goals of (...) human purposes. Geoengineering is a more radical and comprehensive example of this process of planetary management. Thus, as with ecological restoration, geoengineering reinforces the paradigm of human mastery and domination of nature. To counteract this dream of domination, we must, as Dr. Seuss instructed us when we were children, learn to live in the natural world with humility. (shrink)

Sowohl die Reichhaltigkeit wie die Vielseitigkeit seines Werkes dürfte der vornehmlichste Grund für die Tatsache sein, daß nur wenige Denker und um Darstellung bzw. Interpretation bemühte Forscher sich ein gehend und umfassend mit Schelers Philosophie befaßt haben. Hinzu kommt die Unvollendetheit dieses Schaffens, die einerseits auf seinen (...) frühen Tod zurückzuführen ist, die andererseits aber wesentlich in der Eigenart seines Philosophierens verankert ist. They range from highly supportive to quite disputatious; we will repay the supportive ones ironically, by discussing them only briefly. That will allow us to expand a bit on the more difficult comments, and of (...) course the thoughtful reply from Dr. Dick.Knox, Allen, and DownesKnox, Allen, and Downes imagine a world in which effective polygenic scores for alcohol use exist and conclude that even then there would be no way to use them ethically. We agree, for the most part, but there are several distinctions to consider. The first is among physical, medical, psychiatric, and normal-range behavioral phenotypes. Effective polygenic scores exist for height, and to a somewhat lesser extent for medical conditions like coronary heart disease. Whether or not it is a good idea to deploy them in embryo selection or clinical medicine, that is already happening.We do not think an R2 of 0.35 polygenic scores for complex behavioral phenotypes will ever exist, for all the reasons we outlined in the original paper. If we allow ourselves to imagine it happening, however, there are two explanatory pathways to follow. The first is the raw R2, and let’s stipulate that with more enormous samples or exome sequencing or whatever, respectable values are eventually achieved. The second involves the causal validity underlying black-box prediction. Scientists are taking the first step down that path (although not in Spit for Science [S4S], see the reply below to Lee and Morris) by investigating direct and indirect effects between and within families and examining the portability of polygenic scores (PGS) across environments and ancestries. The most convincing causal evidence would involve the kind of mechanistic causal biology about which enthusiasts like to speculate, but there is little sign of that.We will grant another possibility. Suppose there was a PGS for alcohol at an R2 of 0.35 that worked between families and within them, in [End Page 455] North America, South Asia, Central America, and West Africa. Animal models confirmed that it is related to specific metabolic pathways involved in alcohol. It was related but not identical to other successful PGS that predict cannabis use and other addictions. Ancient DNA studies find that it is high in human remains that were preserved next to the casks of wine that they apparently loved. Pharmacologists use it to develop effective medications for withdrawal. This hypothetical PGS, mechanistically opaque though it might remain, would exist in what Cronbach and Meehl (1955) called a nomological network. It would have construct validity, similar to a good self-report questionnaire. Like PGS for coronary heart disease, people would want to have access to construct valid PGS, and there would probably be no way to prevent people from obtaining them. We repeat that we do not expect this to happen, and as we discuss in the response to Dick below, hypothetical discussions of future scientific outcomes usually turn out to be unscientific wishcasting. It is like insisting that cities need to develop traffic control systems for flying cars.SadlerSadler is probably correct that the exigencies of grant funding explain much of what we have observed in S4S. It is certainly a more charitable explanation than the alternatives. It is interesting to consider that one of several revolutions that have occurred in the years since S4S was conceived is in the realm of scientific design and reporting. Preregistration of research hypotheses might have prevented many of the more dubious outcomes of S4S. Yet those ideas have never been applied to grant proposals, as far as we know. Grant reviews reward grandiose promises. No one has ever received funding for announcing that they hope to make incremental progress at the margins of a difficult and perhaps intractable problem. There is no mechanism to check on whether the big promises in proposals were ever fulfilled. What does get checked is whether and where investigators have published, often without regard to what the... (shrink)

In so-called Christian countries an increasing number of people openly reject Christian morality. It is a commonplace that they do this for values that can be shown to be Christian. How did this state of affairs come about? An examination of the beginning of Christian ethical thought shows that, within great personal variety, certain patterns or concepts remain constant. Righteousness, discipleship, faith and love are traced in this book from the New Testament through to Augustine. There is a necessary tension (...) between high ideals and practical performance, or between perfection and contingency. When this tension is lost, Christian ethics can easily go wrong. The amoral perfectionism of second-century Gnostics is remarkably similar to the mysticism of communal movements; the opposite threat of legalism has always been present in conservative forms of Christianity. Dr Osborn is concerned to explain rather than to defend, to look at the way conclusions are reached, and to show the rich diversity of early Christian thought. Frommanns Verlag of new critical editions of Hegel’s 1821 Lectures on the Philosophy of Religion, to be included in one volume with the up to now unpublished first form of his Encyclopedia, and Hegel’s 1824 Lectures on the Philosophy of Religion, in two volumes. The editing of the correspondence of major figures in intellectual history is an essential scholarly activity. Yet in this country in recent years it has neither been the priority it should be, nor has it received the support that it deserves. Of course there have been exceptions to this, perhaps notably – for the early modern period – the epic one-man effort of Esmond de Beer in his later years in producing The Correspondence of John Locke (though this regrettably, and (...) frustratingly, lacks a composite index). A further exception, the edition of The Correspondence of Henry Oldenburg by A. R. and M. B. Hall, was unfortunately flawed by the need to change publishers midway in the series, which has led to a marked disparity in the availability of the latter part of the set compared with its early volumes. In any case, like the Locke edition, this was conceived in the heady days of the 1960s and early 1970s, and few have ventured such enterprises since. Virtually the only exception is Noel Malcolm's edition of the manageable-sized Correspondence of Thomas Hobbes (two volumes, 1994). Moreover, it is revealing of the acute need to justify the publication of such material felt by editors and publishers alike that the promotional leaflet for this edition went so far as to claim that it was ‘one of the most important scholarly publications of the twentieth century’ – a claim that is the more ironic in view of the quite significant shortcomings in its method of presenting the material that it contains. This article offers a comprehensive and critical analysis of Eric Heinze’s book Hate Speech and Democratic Citizenship (Oxford University Press, 2016). Heinze’s project is to formulate and defend a more theoretically complex version of the idea (also defended by people like Ronald Dworkin and James Weinstein) that general legal prohibitions on hate speech in public discourse compromises the state’s democratic legitimacy. We offer a detailed synopsis of Heinze’s view, highlighting some of its distinctive qualities and strengths. (...) We then develop a critical response to this view with three main focal points: (1) the characterisation of democratic legitimacy as something distinct from (and whose demands aren’t identical with those of) legitimacy per se; (2) the claim that the requirements of democracy are hypothetical, rather than categorical, imperatives; and relatedly (3) the question of how we should reconcile the requirements of democratic legitimacy with the costs that may follow from prioritising democratic legitimacy. We argue that there are significant difficulties for Heinze’s account on all three fronts. (shrink)

More than 30 years ago in Annals of Science, Dr. Eric Forbes of the University of Edinburgh published the correspondence between Carl Gauss and Great Britain's Astronomer Royal, Nevil Maskelyne. Five of the letters he listed as missing have now been discovered, along with two entirely new letters he was unaware of. Their nearly complete correspondence can now be read for the first time in 200 years.

Poehlman, Ph.D., was an internationally recognized, tenured professor at the University of Vermont (UVM) in Burlington when, in October 2000, a junior member of Poehlman’s laboratory became convinced that he had altered data from a study on aging volunteers from the Burlington area. This suspicion developed into one of the most significant cases of scientific misconduct in the history of the US Department of Health and Human Services’ (HHS) Office of Research Integrity (ORI), launching a US Department (...) of Justice (DOJ) civil and criminal fraud investigation and, eventually, to a much publicized guilty plea and felony conviction. In the end, Dr. Poehlman admitted to 54 findings of scientific misconduct made by the UVM and ORI, agreed to retract or correct ten of his publications and to exclude himself from federal procurement and nonprocurement transactions for life. The United States Government’s handling of this case was distinguished by a highly cooperative approach that integrated the resources of the US Attorney’s Office for the District of Vermont (USAO) and both ORI and the Office of the Inspector General (OIG) in HHS in the common goal of prosecuting research fraud.
